Terms of Service

Effective date: October 13, 2026

These Terms of Service ("Terms") govern your use of Fledge (the "Service"), operated by Krish Patel, d/b/a Fledge ("Fledge," "we," "us"). By creating or claiming a workspace, starting a trial, or subscribing, you agree to these Terms on behalf of yourself and the business you represent ("you," "Customer"). If you don't agree, don't use the Service.

1. What Fledge is

Fledge provides business information about newly registered healthcare practices (currently dental, chiropractic and physical-therapy practices in Florida), compiled from public sources such as the federal National Plan and Provider Enumeration System (NPPES), U.S. Census geographic data, and other public business records, together with our own filtering, classification and scoring ("Lead Data"). The Service is for business-to-business use only.

2. Accounts and workspaces

  • Each Customer receives a workspace reachable by a private link. You are responsible for keeping your link and your sign-in email secure and for all activity in your workspace.
  • A workspace belongs to the email address that claims it. You must use a business email you control. We may transfer or reset a workspace at your request or to resolve a dispute about ownership.
  • You must be at least 18 and authorized to bind your business.

3. Free trial

New workspaces may include a limited free trial (currently up to 15 lead unlocks within 14 days, no payment card required). We may change, limit or end trials at any time, and we may limit trials to one per business or email domain.

4. Subscriptions, billing and cancellation

  • Plans. Paid plans, prices and inclusions are shown in the Service at the time you subscribe. Founding-member pricing, where offered, applies for as long as your subscription stays active without interruption.
  • Billing. Subscriptions are billed monthly in advance through our payment processor, Stripe, and renew automatically until cancelled. You authorize us to charge your payment method for each renewal and any applicable taxes.
  • Cancellation. You can cancel anytime from Settings → Plan & billing → Manage billing. Cancellation takes effect at the end of the current billing period; you keep access until then.
  • Failed payments. If a renewal payment fails, you keep access for 5 days while you update your payment method; after that your plan ends.
  • Refunds. Except where required by law, payments are non-refundable, including for partial months.
  • Price changes. We'll give at least 30 days' notice of a price change to an existing subscription. It applies from your next renewal after the notice period.
  • Seat limits and exclusivity. We may limit the number of subscribers of a given business type per niche. Exclusive arrangements apply only to the niche, business type and territory confirmed by us in writing (email is enough) and only while your Exclusive plan is active and paid. Exclusive is available only where no other company of your type currently subscribes to that niche in that area; we never remove existing subscribers to create exclusivity.

5. Permitted use of Lead Data

You may use Lead Data only to market and sell your own products or services to the businesses listed, for your internal business purposes. You must not:

  • resell, sublicense, publish, share or otherwise make Lead Data available to anyone outside your business (including other agencies, list brokers or data vendors);
  • use Lead Data to compete with Fledge or to build a competing database;
  • use Lead Data for any decision about a consumer's eligibility for credit, insurance, employment, housing or similar purposes covered by the Fair Credit Reporting Act — Fledge is not a consumer reporting agency;
  • contact individual providers at personal or residential contact points, or harass anyone;
  • scrape, bulk-download beyond the Service's export features, reverse-engineer, or interfere with the Service;
  • share your workspace with people outside your business beyond your plan's seats.

6. Your compliance responsibilities

You are solely responsible for how you contact the businesses in Lead Data and for complying with all applicable laws, including the CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA) and its rules on autodialed or prerecorded calls and texts, the National and Florida Do-Not-Call rules (including the Florida Telephone Solicitation Act), state privacy laws, and professional-advertising rules. Honor every opt-out request promptly. Fledge does not send messages on your behalf and does not provide legal advice.

7. Data accuracy and bad-lead credits

Lead Data comes from public records and automated processing and may contain errors, omissions or outdated information. Scores and labels (for example "new opening" or "ownership change") are our estimates, not guarantees. If a lead is clearly wrong (for example a disconnected number, not a new practice, closed, or a duplicate), report it from the lead's "Report a bad lead" link; at our discretion we'll credit you (for example with a replacement unlock). That is your sole remedy for inaccurate Lead Data.

8. Listed practices: opt-outs

Businesses and providers may ask us to remove their information from the Service by emailing fledgeleads@gmail.com. We'll remove them from future Lead Data; you must also stop using removed records that you've exported once notified.

9. Intellectual property

The Service, its software, design, scoring and compilation are owned by Fledge. Public facts in the underlying records are not owned by us, but our compilation, classification and scoring are. We grant you a limited, non-exclusive, non-transferable license to use the Service and Lead Data under these Terms during your subscription. Feedback you give us may be used freely.

10. Suspension and termination

We may suspend or terminate access if you breach these Terms (including Section 5 or 6), fail to pay, or create risk or legal exposure for us or others. On termination, your license to use Lead Data ends, except that you may keep using records you exported while subscribed for your own internal purposes, subject to Sections 5, 6 and 8.

11. Disclaimers

THE SERVICE AND LEAD DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, FLEDGE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. We don't guarantee any sales results.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FLEDGE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID US IN THE 3 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

13. Indemnity

You will defend and indemnify Fledge against claims, fines and costs arising from your use of Lead Data, your marketing or outreach, or your breach of these Terms or applicable law.

14. Changes

We may update these Terms. For material changes we'll notify you by email or in the Service at least 14 days before they take effect. Continuing to use the Service after that means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Pinellas County, Florida, and you consent to their jurisdiction.

16. General

These Terms are the entire agreement between us about the Service. If any part is unenforceable, the rest remains in effect. You may not assign these Terms without our consent. Our failure to enforce a provision isn't a waiver.
